Man sentenced to jail after teasing disabled girl

An Ohio man faces one month of jail time for teasing and taunting a 1o-year-old girl with cerebral palsy after a video of the incident went viral.

On Nov. 27, Judge John A. Poulos of the Canton Municipal Court sentenced 43-year-old William Bailey to 29 days in jail.

The taunting occurred on Sept. 26, when Tricia Knight and her mother-in-law were waiting for her children's bus to return from school. Knight's three children, including 10-year-old Hope, attend Walker Elementary with Bailey's 9-year-old son, Joseph.

What happened next was caught on an iPod camera by Knight's mother-in-law, Marie Prince.

William Bailey "was dragging his leg and patting his arm across his chest to pick his son Joseph up," said Knight. "I asked him to please stop doing this. 'My daughter can see you.' He then told his son to walk like the R-word."

The next day Knight posted the video on her Facebook page while Prince uploaded the video they called "Bus Stop Ignorance" to YouTube. Within days, the video went viral.

The Knight family has lived next door to the Baileys for the past two years, and the incident at the bus stop, according to Knight, is the culmination of rising tensions and intimidation against her kids.

In the days that followed the taunting at the bus stop, the Knight family filed a complaint with Canton City prosecutors.

Jennifer Fitzsimmons, the chief assistant city prosecutor for this case, says in the three years she's been in this role, she's never seen anything like this.

"I think when we look at cases, there's case law out there regarding people commenting and gesturing against race and religion. But when there's nothing out there regarding disabilities, it took me a little bit longer to come to a decision."

After Fitzsimmons reviewed the Knight family's complaint, a police report based on a phone call from the Knight family, and the video captured by Prince, she decided to press charges.

"It was settled without Hope having to relive what she saw and how it impacted her," said Fitzsimmons. "I think the trial could have been just as traumatic as the event itself."

Bailey, who works as a truck driver, was charged twice. He was originally charged for aggravated menacing, a misdemeanor of the first degree. In this charge, the victim was Knight, an incident she says took place the same day as the bus stop scene.

Bailey, she said, "was swinging a tow chain on his porch, saying he was going to choke me until I stopped twitching. I sent my kids with my mother-in-law to leave with them. My husband called the sheriff."

In Ohio, a menacing charge is a misdemeanor fourth degree, which carries a maximum of 30 days in jail.

The second original charge, for the bus stop incident, was disorderly conduct, a misdemeanor of the fourth degree. A disorderly conduct is a minor misdemeanor and carries no jail time.

Although Bailey's sentencing technically reflects the charges brought by his actions toward Knight, Hope's mother, Fitzsimmons explains how the plea deal enabled the sentence to cover his actions toward Hope.

"Because the menacing misdemeanor charge was directed toward Hope's mother, and they're all interrelated, the judge took into account all the actions of Mr. Bailey and the entire Holcomb family," said Fitzsimmons.

Bailey "entered a plea of 'no contest' to a menacing charge and to disorderly conduct," said Fitzsimmons. His sentence will go into effect on Jan. 2.

Judge Poulos required Bailey to pay $400 in court costs as well as other fees. He was given a credit for one day which is why his sentence is 29 days and not the maximum 30.

Following the Nov. 27 hearing, Bailey's attorney, John R. Giua, released a statement and apology on Bailey's behalf, according to the The Repository, an online newspaper for Stark County, Ohio.

"I don't think this sentence will change things because it hasn't so far," said Knight.

Knight says living next door to the Baileys affects their everyday lives.

Just last summer, said Knight, 9-year-old Joseph Bailey came over to play with Knight's children and brought over a pocket knife, threatening to "cut [Hope] up," followed by name calling. That harassment continued into the school year.

Since the bus stop incident, Knight has spoken with the bus driver and the school's principal. Knight now drives Hope to school every day while her other two children ride another bus to school.

Hope was born 29 weeks premature after Knight was involved in a head-on auto collision. When she was born, Hope weighed only two pounds, 12 ounces, which caused several medical problems resulting in two brain surgeries. Knight says her daughter fought for her life the first two years.

As for whether this case presents a new precedent in Ohio is another debate.

"I don't know if it sets a precedent so much maybe as it begins a conversation between people," said Fitzsimmons. "I think conversation starts progress, and I think if it can bring something else to light, it would be good."

Energy efficient windows ? Home Improvement: House Plans

November 20th, 2012 by admin Leave a reply ?

I must change the windows of my home. My old windows aren't bad looking. But although they go well with the house and I still like them, they are lacking the much needed energy efficiency. Heating and cooling my home takes five times longer than it is supposed to. I talked to the contractor that I always use, and after inspecting them, he told me that is time for windows upgrade. Because I really like the window design I have, I went in search for the similar window style only with a better energy efficiency index. I found something that looks promising at the Nitro Windows store my next door neighbor suggested. I?ll see soon enough how they will do.?

Bidens host wounded warriors for Thanksgiving dinner

The mouth-watering smells of stuffing and turkey, a crackling fire, guests with bowed heads giving thanks for "second chances"?Vice President Joe Biden and Dr. Jill Biden hosted their fourth Early Thanksgiving for Wounded Warriors on Monday, welcoming servicemen and -women and loved ones to the Naval Observatory.

"Jill and I want to welcome you to the vice president's home. This is your home," Biden said in brief remarks as the 26 guests sat at two large tables in the residence's dining room. He spoke from behind a lectern with the VP's seal on it, Jill Biden at his side. Candles fluttered over their shoulders on the mantelpiece of the fireplace, in which a robust blaze was already crackling. A Navy harpist played before his remarks.

The vice president said he and his wife were "honored and, quite frankly, flattered" to host the dinner. "It's one of the highlights and honors of this job."

"We're just so incredibly proud of you," Biden said. "We can never?and I mean this sincerely?never, ever repay you and your families for the sacrifices you've made."

The wounded warriors are all being treated at Walter Reed National Military Medical Center, the vice president's office said. They were chosen "because they have indicated they will likely not be able to leave the D.C. area to be with family for the Thanksgiving holiday." There were five from the Army, four from the Marines and one from the Air Force. Two were in wheelchairs.

Hungry little Oliver Elliott, the 8-month-son of Marine Corps Capt. Tommy Elliott of St. Claire, Ill., sang out a couple of times from his high chair as Biden spoke. "Don't worry about the baby, it's OK," the vice president assured his guests. Oliver grew quiet when his mother, Deborah, gave him his bottle.

Biden paid tribute to military families, noting that his son served in Iraq for a year. He described how, during Beau Biden's deployment, he would find Jill Biden in the kitchen every morning, mouthing a prayer. More than once, he noted that only a tiny percentage of Americans had served in the wars in Iraq and Afghanistan.

Biden promised the wounded veterans that "the most encouraging thing you're going to see in your lifetime, in the near term, is some incredible, incredible, incredible medical breakthroughs" in everything from prosthetics and treatment for severe brain injuries to help for post-traumatic stress.

Jill Biden, who wore a Blue Star Mother pin signifying that she's a military mom, also cited her son's time in Iraq.

"Our son Beau was deployed four years ago, so I know what it's like to have a loved one who's not at the table," she said. She also highlighted her work with military families.

"As Joe said, I do believe in the power of prayer. And it was prayer that helped me get through that year," she said. "And I think probably for many of you it's prayer that'll help you get through these tough times."

Chaplain Stan Fornea said a prayer, and the assembled diners bowed their heads. He gave thanks for "the gifts of freedom, love, opportunity and second chances."

"The bad news is you guys at this table start off with me," Biden said, drawing laughs from the guests. The Bidens planned to meet all of their guests throughout the meal.

For those curious about what the meal included, here is the menu, provided by the vice president's office:

"Buttermilk Brined Roast Turkey ?w/ Lemon-Parsley Gravy
Country Bread Dressing
Parmesan Mashed Potatoes
Graham Cracker Sweet Potato Gratin
Roasted Vegetable Macaroni & Cheese
Snap Beans w/ Caramelized Shallots & Roasted Mushrooms
Fall Harvest Salad
Apple-Pecan Cranberry Relish
Maple-Ginger Pumpkin Pie?Old Fashioned Lattice Apple Pie?& Thanksgiving Pecan Pie"

Two police helicopters collide over California helipad, injuring six

Two police helicopters collide over California helipad, injuring six | World news | guardian.co.uk

Both aircraft damaged after police suspect rotator blades of landing chopper touched those of a second one taking off

  • guardian.co.uk,

Two police helicopters collided over a helipad Saturday, leaving five police officers and a civilian with minor injuries, officials said.

Police believed the collision occurred when the rotator blades of a chopper that was landing and one that was taking off touched, Lt Phlunte Riddle said.

The collision caused extensive damage to both aircraft, crumpling the tail and breaking the blades of one and causing the blade to fall off and other damages to the other.

The injured were taken to hospitals for evaluation after the 4pm collision at a helipad in Altadena. Riddle said they included a pilot and an observer in each of the Bell OH-58A helicopters and two officers on the ground. One of the observers was a civilian.

The weather was drizzly and cloudy at the time of the accident.

FAA spokesman Allen Kenitzer said his agency and the National Transportation Safety Board will investigate.

The collision follows a much more serious crash in Atlanta this month where two officers in a police helicopter were killed when the aircraft hit wires atop a power pole.

Education & Technology - The Year of the MOOC

Education 2.0 ? Massive Open Online Courses

What is a MOOC anyway?

MOOCs are massive open online courses. As opposed to traditional courses that have tuition and limited enrollment, MOOCs are free and open to the masses.

How are MOOC?s structured?

The large numbers associated with MOOCs mean that instructors can not possibly respond to students on an individual basis. Classmates therefore rely on each other, organizing online study groups and working in online forums for help. Lectures are given via video and in-lecture quizzes make sure you understand the material. Teaching assistants oversee discussion boards and feedback for homework and exams is electronic.

Where did the idea for MOOCs come from?

The roots of massive online open courses can be traced back to the American inventor Douglas Engelbart who advocated for the utilization of the computer as a cooperative tool for intellectual growth. Since then, many educational reformers have advocated for the use of computing technology integrated into the learning process and openness in the educational process.

In 2004, an early version of the MOOC was developed by Sun Microsystems. Concepts and lessons learned from these approaches influenced a nonprofit organization, Curriki, which has created an online repository/community for curricula and has more than 300,000 educator, parent, and student members. Curriki?s online community connects educators from around world and enables the sharing of curriculum and best practices.

In the fall of 2011, the idea of a global community of learning gained massive attention when more than 160,000?people signed up for an artificial intelligence course offered by Sebastian Thrun and Peter Norvig (through the company now known as Udacity). Following the popularity of Thrun and Norvig?s course, Daphne Koller and Andrew Ng launched two MOOC?s from Stanford University through the company Coursera. MIT later that fall launched MITx as an effort to develop a free, open platform for online education. The first course launched in March 2012 was 6.002x with more than 155,000 participants. Harvard and the Berkeley joined MIT?s initiative later that year and MITx was renamed edX.

In reference to MOOCs, Anant Agarwal president of edX said that he would ?like to call this year the year of disruption and the year is not over yet.? This fall, edX has more than 370,000 students in its inaugural classes. Coursera, now offering courses from 33 of the most elite universities, has reached more 1.7 million students.

The rise of MOOCs means that we should begin thinking about how free, top-quality education can change our world. The education that can be spread through MOOCs is not limited by geography or political boundaries. 60% of students in MOOCs are ambitious young people from countries like India, Brazil and China. Will supersized education be the propellant needed to spur innovation globally? Will MOOCs knock down the barriers to a good education? We can only hope.

The Walking Dead, Season 3

Glenn (Steven Yeun) in Walking Dead Glenn (Steven Yeun) in Walking Dead

In?Slate's?Walking Dead?TV Club, Chris Kirk will IM each week with a different fan of The Walking Dead. This week, he discusses ?Hounded? with Katy Waldman,?Slate assistant editor and editor of the Slate Dexter TV Club.

Chris: Katy, you?ve never seen an episode of The Walking Dead. What's the experience like as a first-time viewer?

Katy: I think I would have benefited from knowing more backstory. But on the other hand, there's a visceral quality to the violence that requires very little explaining.

Chris: This episode opens with Merle and his posse hunting for Michonne, who has skipped Woodbury, which doesn?t make the governor happy, I guess. After Merle ignores Michonne?s ?bitergram? warning him to go back, Michonne descends from the trees and, wielding her ?little pig-sticker,? stabs one thug and decapitates another before she disappears again into the forest. Merle sinks his arm-blade into the head of the first downed man and instructs ?Neil? to brain the severed head of the second so they don?t reanimate. A follow-up fight leaves Michonne drenched in guts. The Walking Dead has to be violent?it's a show about zombies, after all?without nauseating viewers. Do you think it strikes the right balance?

Katy: Short answer: No. Sure, my take might be compromised by the fact that I know nothing about the characters and am not invested in their stories. As the massacre you just described was unfolding, all I saw were puppets lopping off one another's body parts.

Chris: Regular viewers hardly knew the people who died in this episode, so they might as well have been puppets. Then again, if I cared to know the backstory of every guy who gets disemboweled or decapitated or dismembered, The Walking Dead would be aptly retitled The Boring Living.

Katy: But the living are what gave this episode real energy. I was surprised to find the humans in this show seem so much scarier than the zombies. The zombies appear placid, aimless, and unthreatening. But the survivors have so much passion and intensity. They are the ones who seem likely to inflict real damage on one another.

Chris: Merle seems particularly dangerous. I thought he had softened up this season, but by the time he stumbled upon Glenn and Maggie, I wished Glenn had the brass to shoot him instead. Instead, Merle kidnaps them and takes them to Woodbury.

Katy: It was hard to care what happened to them. Their dialogue was pretty boilerplate. But later, I felt for Rick on the phone.

Chris: In the prison, Rick answers the phone that started ringing at the end of last week?s episode. It?s not a robocall from Mitt Romney, after all, but a call from ?survivors? who turn out to be figments of Rick?s imagination?phantoms of the people who have died, including Lori, here to haunt him over his failure to protect them. I thought it was a lazy way for the writers to bludgeon viewers over the head with Rick?s guilt.

Katy: That whole plot twist was just a dead end, literally. Lots of suspense with very little payoff. If I were a religious watcher of The Walking Dead, I'd be pissed!

Chris: Part of me wishes that it hadn?t been Rick?s imagination. That?s the kind of shockingly inexplicable moments that you would have seen on Lost. But it wouldn?t fit The Walking Dead, which ties up its loose ends pretty quickly. Carol goes missing only for an episode before Daryl finds her in the prison.

Katy: The dynamic between the governor and Andrea interested me. I would have liked more moments like those, overall.

Chris: Back in Woodbury, Andrea is bored and wants a job on the wall. When the first zombie appears, she jumps down, knifes it, and exclaims, ?that is how it?s done!? She admits that she enjoyed the sport she saw in the last episode in which villagers brawl in a ring bordered by chained zombies. After some flirtatious banter, Andrea and the governor have sex. Katy, you basically know just as much about the governor as Andrea does. What?s your take on him?

Katy: I found the governor perfectly nice. His enjoyment of violence rang some alarm bells, but he later explained that away in his scene with Andrea as a necessary part of being a survivor. I assumed he'd been scarred and brutalized by his experiences, and didn't really hold it against him.

Chris: This episode seems very meta. Andrea condemns the Woodbury fights. ?It's brutality for fun,? she says, and even though she adds that ?the world's brutal enough already,? she ultimately admits that she liked the fight, even though she didn?t like that she liked it. Is this a metaphor for The Walking Dead itself? I just don?t think it?s a coincidence that AMC?s most brutal show is also its most popular.

Katy: That's really interesting. Maybe some people do get drawn in by the gore, even in spite of themselves. I have to confess that watching this show convinced me that I'm not one of these people, for better or worse.

Chris: To close up here: Every serial drama faces two challenges. First, it must retain the viewers it has. Second, it must bring new viewers into the fold.

Katy: Forget it. Not happening.

Chris: Stick with Dexter?s table, then. The Walking Dead isn?t for everyone.

Tomorrow: What?Slate?commenters and critics around the Web thought of this episode.

Facebook And Yahoo Discussing Search Partnership, Report Says

13202v15-max-250x250Yahoo CEO Marissa Mayer and Facebook COO Sheryl Sandberg are discussing a potential partnership, according to a report in The Sunday Telegraph. The story is based on anonymous sources, who seem primarily to be "Yahoo insiders." It's vague on the details of the partnership, perhaps because those details are still being worked out, but "board members expect the talks to lead to much more substantial collaboration based around web-based search."

Biggest Mistakes Aspiring Real Estate Investors Make | FECEPAC ...

As an instructor of beginning real estate investors, one of the questions I?m asked most often is, ?Why can?t I get started ? what am I doing wrong?? Maybe you?re an aspiring real estate investor wondering the same thing. You?ve seen lots of others get going, yet you?re still sitting on the bench and wondering why. You aren?t alone if you are. There is usually more than one reason that keeps people from starting out. In this article, I will lay out the most common reasons why some people get going like ?gangbusters? while others don?t. I?ll address one or two f the reasons here and explain more of them in follow up articles.

So here are the top 5 reasons some aspiring real estate investors have trouble starting out. I?ve given them in the order I consider to be most relevant.

? Listening to and buying into the ?get rich quick? infomercial, webinar gurus.

? Failing to get a PROPER investing education.

? Not understanding the market fundamentals.

? Fear of taking action.

? Not making offers.

In my experience as an instructor of beginning real estate investors, those are the top five reasons. I know there are many more, but let?s explore one of these right now. We?ll get to the other reasons in future articles.

First mistake, and probably the biggest, is listening to and buying into the get rich quick infomercial or webinar gurus out there. Not only is this a big mistake, but it?s a colossal waste of time and money for the most part as well. Here?s why.

Prior to the 70?s, real estate investing education consisted primarily of buying a property, fixing it, renting or selling it, and then learning from the profit or loss you experienced.

In the late 70?s, and early 80?s we witnessed the birth of the ?multi-day seminar.? These were advertised with full-page ads in newspapers, and held in hotels across the nation. Initially, these filled a need, but they also spawned a couple of other trends, namely real estate investor associations or REIA?s and the explosion of local, regional, and national seminars. All of these varied in content and quality. In the late 90?s and into the 2000,s the ?webinar? gained popularity. Again, all of these vary in content and in quality.

The one constant from the multi-day seminar all the way through to the webinars of today is that they are all a sales pitch of one sort or another. For the most part, the promoters of these webinars are trying to sell you their latest ?course? or product, but more importantly they are ?farming? for your email address. You see, that?s modern day, internet marketing. If you don?t buy whatever it is they are selling on their webinar, they?ve got your email address to bombard you in the future with other products they are selling. Some of them even make money selling your email address to other gurus enabling them to flood your email with their products too. In short, you learn very little (if anything) from most of these, and you are basically giving them your money.

The RIGHT way to get started as a real estate investor is with a proper education. This includes the fundamentals, goals, ALL the different strategies available, contracts, negotiating, financing, exit strategies, building a team, and more. You won?t get that from the webinar or informational gurus out there.

To summarize, your real estate investing education is the tool that can generate lots of money for you. If you make the wrong choice, your investment with infomercial or webinar gurus could wind up costing you thousands more. The old adage ?you get what you pay for? is true in a lot of things. It?s gospel in real estate investment education. Get the proper training so you don?t make the biggest mistake a lot of beginning real estate investors make.

Sony to release XAVC video format SDK to 4K developers

Sony has announced that it'll release an SDK to 4k developers this month for its recently launched XAVC video format used by the new F5 and F55 CineAlta camcorders. The new specification uses MPEG-4 AVC/H.264 video compression, which allows up to 12-bit color depth, 60 fps shooting speed at 4k and 180 fps in HD. So far, fourteen companies including Adobe and Apple have signed on as licensees, and Sony says the format may come to consumer products as well. Details of the program along with an SDK will arrive this month, just in time for a possible Ultra HD onslaught.

Austerity protests stall several European nations

BRUSSELS (AP) ? Hundreds of thousands of Europe's beleaguered citizens went on strike or snarled the streets of several capitals Wednesday, at times clashing with riot police, as they demanded that governments stop cutting benefits and create more jobs.

Workers with jobs and without spoke of a "social emergency" crippling the world's largest economic bloc, a union of 27 nations and half a billion people.

The protests were met with tear gas in Italy and Spain, but were largely limited to the countries hardest hit by the austerity measures designed to bring government spending into line with revenues. Wealthier nations like Germany, the Netherlands and Denmark saw only small, sedate demonstrations.

Governments backing the line of stringent austerity were not impressed by the show of force.

"We must nevertheless do what is necessary: break open encrusted labor markets, give more people a chance to work, become more flexible in many areas," German Chancellor Angela Merkel said. "We will of course make this clear, again and again, in talks with the unions."

Spanish Economy Minister Luis de Guindos spoke of "a long crisis that has meant sacrifice and uncertainty," but said: "The government is convinced that the path we have taken is the only possible way out."

To combat a three-year financial crisis over too much sovereign debt, governments across Europe have had to raise taxes and cut spending, pensions and benefits. As well as hitting workers' incomes and living standards, these measures have also led to a decline in economic output and a sharp increase in unemployment.

The zone of the 17 countries that use the euro currency is expected to fall into recession when official figures are released Thursday. Unemployment across those countries has reached a record 11.6 percent, with Spain and Greece seeing levels above 25 percent.

With no end in sight to Europe's economic hardship, workers were trying to take a stand on Wednesday.

"There is a social emergency in the south," said Bernadette Segol, secretary general of the European Trade Union Confederation. "All recognize that the policies carried out now are unfair and not working."

Spain's General Workers' Union said the nationwide strike ? the second this year ? was being observed by nearly all workers in the automobile, energy, shipbuilding and construction industries. The country, reeling from austerity measures designed to prevent it from asking for a full-blown international bailout, is mired in recession with 50 percent unemployment among its under-25s.

Ignacio Fernandez Toxo, a CCOO Spanish union leader, called Wednesday's actions "a political strike against the policies of a suicidal and anti-social government."

The Spanish strike shut down most schools, and hospitals operated with skeleton staffs. Health and education have both suffered serious spending cutbacks and increased moves toward privatization.

Frustration spilled into violence when riot police clashed with demonstrators in Madrid and other Spanish cities. By late afternoon, 110 people had been arrested and 40 people, including 18 police, injured.

In Italy, protests turned violent as well, with some of the tens of thousands of students and workers clashing with riot police in several cities. Dozens of demonstrators were detained and a handful of police were injured, according to Italian news reports.

In bailed-out Portugal, where the government intends to intensify austerity measures next year, the second general strike in eight months left commuters stranded as trains ground to a virtual halt and the Lisbon subway shut down. Some 200 flights to and from Portugal ? about half the daily average ? were canceled. Hospitals provided only minimum services and municipal trash was left uncollected.

Protest marches in 40 Portuguese cities reportedly were peaceful but as night fell a small group of protesters threw rocks and bottles at riot police protecting the parliament building in Lisbon.

Airports across Europe were forced to cancel flights to and from striking nations.

In Belgium, a 24-hour rail stoppage severely disrupted the Thalys and the Eurostar high-speed rail services ? vital links that connect Brussels, London and Paris.

Philippe de Buck, chief of the EU employers' federation Eurobusiness, said the strike would cost billions of euros and hurt Europe's ability to attract investors.

"If you start striking at national level and in companies you only will harm the economy," he said. "And it is not the right thing to do today."

Europe has a long history of union action, and workers' rights and benefits have been one of the cornerstones of its welfare state, with its guaranteed medical care, generous unemployment benefits and often comfortable pensions.

The union action was not felt across the entire region, however, with countries where austerity has not hit as hard experiencing little disruption.

In Austria, which has the eurozone's lowest unemployment at 4.3 percent, only about 350 people gathered in a central square in Vienna to express solidarity with Greece. Many danced a sirtaki, Greece's traditional dance.

"So far, there are only symbolic demonstrations here in Germany, because we were able to avoid the crisis," said Michael Sommer, the head of Germany's main labor union federation.

In Denmark, too, there were no strikes, since cooperation between workers and employers has largely survived the crisis.

"The employers speak the same language as we do and we understand each other's needs and demands," said Joergen Frederiksen, a 69-year-old retired worker and former shop steward. "There are good vibes between us and that means a lot."

Samsung Chromebook Series 3 (XE303C12)

The Samsung Chromebook Series 3 (XE303C12) may be the Chromebook that really takes off. With a price low enough to entice the curious and the parts needed to zip through Web browsing, the new Chromebook is what we've wanted Google to deliver all along, an affordable and portable way to hop online. Earlier models have cost upwards of $400, leaving a lot of users feeling ripped off at the limitations of Chrome OS. At $250 for the Wi-Fi connected model, the price is right, and the new Chromebook is even cheaper than our current Editors' Choice Budget Laptop, the Acer Aspire 5349-2635 . It's also a good deal cheaper than both the Samsung Series 5 Chromebook 550 (XE550C22-H01) and the Samsung Chromebook Series 5 , making this the closest any Chromebook has come to meeting Google's initial goal of selling the Chromebook for $200.

If you can come to grips with using cloud-based tools like Google Docs and Google Drive instead of regular software and local storage, the Chromebook becomes extremely enticing, especially for writers and students, who may not require much more than Word processing and Web access. The Chromebook is also tempting when compared with more expensive tablets, which don't offer the same level of productive capability or a physical keyboard. The Chromebook has always been a niche product, but at this price, there are plenty of little spaces to fill.

Design
The Chromebook Series 3 may be inexpensive, but it doesn't feel cheap. The lightweight plastic construction may not be luxurious, but the Chromebook is sturdy, and the plain silver styling owes a lot to the Apple MacBook Air 11-inch (Mid 2012) . The 11.6-inch display has the same 1366-by-768 resolution seen on both the MacBook Air and the Microsoft Surface with Windows RT . You may have to limit your side-by-side multitasking, but Chrome has always favored tabs anyway.

This thing is ultrabook thin?0.69 inches?but it's more like a netbook in terms of hardware, packing a new ARM processor (more on that below). The reality is that it doesn't quite fit into either of these categories comfortably, but still finds a place among other inexpensive and portable laptops. Weighing only 2.5 pounds, the Chromebook Series 3 is extremely portable, while still offering a large enough screen and keyboard to use without feeling hemmed in. Despite the slim build and complete lack of cooling fans, the system never got particularly warm during testing.

The Chromebook Series 3 doesn't have a standard keyboard. It's still a full-size QWERTY keyboard, but the layout has been tweaked by Google to optimize the Web-based Chrome experience. The Caps Lock key is replaced with a dedicated search button (you can still Caps Lock by pressing Alt-Search), and F1-F12 have been replaced with Chrome-specific function/hotkeys (Across from left to right: Escape, Back, Forward, Reload, Full Screen, Next Window, Brightness Down/Up, Volume Mute/Down/Up, Power). The Delete key has also disappeared, with the Backspace key pulling double duty (to delete, just press Alt-Backspace). There is no equivalent to the Windows or Apple key, just wider Ctrl and Alt keys, which will actually get plenty of use, as the Chrome OS offers a lot of keyboard shortcuts. After a few days of using the Chromebook, I found that Chrome's keyboard navigation was both fast and intuitive, more so than I have found on various Windows machines. If you're a Chrome user on a Mac or Windows PC, you'll find that many of the same shortcuts and key combos are the same.

The trackpad on the Chromebook Series 3 is a single-piece, blank-faced clickpad, without the usual right- and left-click buttons, just one touchable clickable touchpad. Google has also tweaked it for faster navigation in Chrome, with one- and two-finger gestures, like tapping with a single finger for a standard mouse click, and tapping with two for right-click functions. Two-finger scrolling is a breeze, and click-and-drag functions work easily.

Features
The defining feature of the Chromebook Series 3 is not its hardware, its price tag, or even its unique keyboard; it's Chrome OS. Google's Web-centric operating system is little more than the Chrome Web-browser, with web-apps built-in, and some added offline functionality.

Dedicated icons in the lower left corner of the screen pull up Gmail, Google Search, Google Drive, and YouTube. A selection of apps offers even more Chrome Apps, like Chrome Web Store, Google Calendar, Google+, a calculator, camera (which uses the Chromebook's webcam), and Chrome Remote Desktop, which lets you access other PCs remotely through the browser. It's a workable (albeit slow) solution to Chrome users who want to either access their primary computer and software, or who need to do some remote troubleshooting for a relative. In an effort to expand the usefulness of these apps, Google has also added offline capability to Google Drive and Gmail, letting you access at least some of your stuff when Wi-Fi isn't available. Further apps and extensions can be found in the Chrome Web Store, with thousands of offerings, many for free.

There's also a basic file manager in Chrome OS, but the key word here is basic. Plug in a USB flash drive or SD card and it will pop up a list of the drive's contents, with an interface that looks much like Gmail or Google Drive. Documents and PDF files are opened using Chrome's in-browser document viewer, while photos are viewed and edited with Chrome's light image editor. Music and video files are opened with Chrome's media player, but Google expects most media to be streamed over Wi-Fi (using apps like Google Play Music), and for robust cloud-based editing tools (such as Aviary and Creative Kit in Google+) to be used for extensive media editing.

In terms of features, the selection is surprisingly robust. On the back of the laptop along the hinge are an HDMI out port, one USB 3.0 port, and a USB 2.0 port. On the left edge of the machine is a combination headphone and microphone jack, and a card reader that supports various SD formats (SD/SDHC/SDXC). Dongles are also available for Ethernet (via USB) and VGA output.

Because the Chromebook Series 3 is so dependent upon Internet connectivity, it has built in 802.11 a/b/g/n WLAN, and Bluetooth 3.0 for connecting to headsets, printers, or other peripherals. Also on the back of the laptop is a SIM card slot, which is only used in the 3G-equipped model, which is available for $329.99 (direct), with Verizon 3G. Verizon offers 100MB of free data per month, but you can also purchase extra data as needed.

Internal memory is sparse, with only 16GB of internal flash memory?file storage is expected to be in the cloud, primarily using Google Drive. To encourage this transition, new Chromebook owners are offered a free 100GB upgrade to their Google Drive capacity, good for two years. Samsung covers the Chromebook with a one-year warranty.

Performance
The Chromebook Series 3 ditches the Intel Atom and Celeron processors used in the previous Chromebooks in favor of Samsung's Exynos 5 dual-core ARM processor (1.7GHz). Paired with 2GB of RAM, it makes the most of the feather-light operating system, zipping along quickly from page to page and document to document. It also boots pretty quickly, springing to life when you open the lid, and prompting you for a password within eight seconds. It's not quite as fast as the two-second wake times offered by ultrabooks, but it's a good deal faster than the usual Windows 7 PC.

While we aren't able to test the Chromebook as we would a traditional Windows laptop, we still were able to test it's overall speed using BrowserMark. While it may not top Windows PCs outfitted with Intel Core processors, it was significantly faster than Microsoft's Surface RT tablet, making a strong case for the inexpensive laptop being a better web-browsing device than the Surface RT.

We tested battery life by streaming a 10-hour YouTube video over Wi-Fi, similar to the video rundown tests used on other systems, but leaning more heavily upon the Wi-Fi usage, as the Chromebook is hobbled without Internet access. The Chromebook Series 3 lasted 5 hours 25 minutes, which is in line with the 6.3 hours that Samsung estimates for regular usage.

The Samsung Chromebook Series 3 may not rival the latest ultrabooks in processing power, or offer the touch interfaces of tablets and smartphones, but it offers a reasonably priced laptop for those who can get by with web access and cloud-based storage and tools. For budget buyers that don't need much more than a way to get online, the Chromebook is even more affordable than the Editors' Choice Acer Aspire 5349-2635, and is a more palatable option than the more expensive Samsung Series 5 Chromebook 550 (XE550C22-H01). It's also several hundred dollars cheaper than the Microsoft Surface RT tablet, which may have a slick design, but suffers from many of the same limitations. Whether you're a writer pounding out verbiage at Starbucks or a college student researching a term paper, the Samsung Chromebook Series 3 may be all you need, at a price that's hard to ignore.

Letters: After the Storms (2 Letters)

In ?Speaking His Mind, Beyond the Forecast? (Nov. 6), the meteorologist Bryan Norcross rightly compliments the National Oceanic and Atmospheric Administration on its superb storm forecasting but faults it for failing to label Sandy a ?hurricane.?

Yet the problem here is not the science, which was nailed by the forecasters, but rather how to best communicate it. Most of us get our weather from local TV weather people, who are generally not meteorologists and who offer commentary of questionable value, especially in storms.

Clearly, this is a serious matter that must be handled in a professional manner. There are lives at stake in addition to TV ratings.

To the Editor:

Re ?Costs of Shoring Up Coastal Communities? (News Analysis, Nov. 6): Proponents of beach replenishment want it all ? private beach-front playgrounds, sand to repair their beaches, and seawalls to protect their property, all at taxpayer expense.

As sea levels rise, these people will become more and more strident in their demands that the rest of us bail them out. It is time to stop subsidizing foolish land use and let the ocean do its work.

Your Health: Most colon cancer easily treatable if found early via ...

Tuesday, November 13, 2012

Colorectal (colon) cancer is the third most commonly diagnosed cancer and the second leading cause of cancer death in the nation. In Kentucky, colorectal cancer is the second most common cancer, behind lung cancer in both men and women.
?

Each year, more than 2,500 Kentuckians are diagnosed with colorectal cancer and more than 900 die from this disease. According to Kentucky Cancer Registry data, many of these cases are invasive, late-stage cancers. It is suggested that at least 60 percent of colorectal cancer deaths could be prevented by following the screening guidelines.
?

Colorectal cancer usually starts as a polyp (a growth) that is not yet cancer but if left undetected has the potential to become cancerous. Screening tests can find polyps and remove them before they turn into cancer. Also, screening tests can help find colorectal cancer early, which increases the chance of being cured.
?

Precancerous polyps and early-stage colorectal cancer do not always cause symptoms. That is why screening is so important. If you wait until you have symptoms, it?s possible that the cancer could be an advanced stage, making it more difficult to treat. If found early, the cancer could be removed surgically, and you may not need chemotherapy.
?

A colonoscopy is the most common test for finding polyps. During the colonoscopy, a physician uses a lighted tube to look inside the entire colon. If the physician finds a polyp or anything suspicious, he or she can remove it or take a piece of it and test it for cancer. Patients are usually given a mild sedative and sleep through the procedure.
?

If you are 50 or older it is recommended that you be screened for colorectal cancer. It is important to talk to your doctor about getting screened for colorectal cancer and the type of screening test that is appropriate for you. You may need to be screened at an earlier age if a family member has had colorectal cancer or if you have symptoms. Some common symptoms of colorectal cancer is blood in your stool, unexplained weight loss, fatigue, change in bowel habits (constipation or diarrhea), and persistent abdominal discomfort (fullness, bloating or cramps).
?

The American Cancer Society estimates that 9 out of 10 colorectal cancers could be prevented or cured by screening or regular checkups. Prevention and early detection is the key to stopping this deadly cancer. Colorectal cancer screening can save your life.

Feinstein: Petraeus may still be called in Benghazi inquiry

WASHINGTON (Reuters) - Despite an adultery scandal that ended David Petraeus' tenure as CIA chief, the general may be called to testify in a Senate inquiry into the killing of four Americans at the U.S. consulate in Benghazi, Libya, Senator Dianne Feinstein said Sunday.

Feinstein, the chairwoman of the Senate Intelligence Committee, said on the "Fox News Sunday" program that Petraeus' resignation on Friday "was like a lightning bolt."

She said there will be an investigation into why the FBI failed to inform her and others on the intelligence committee before Friday about the extramarital affair between Petraeus and his biographer, Paula Broadwell, when the FBI probe had been proceeding for weeks.

The California Democrat said there was no connection between Petraeus' resignation and the September 11, 2012, killings in Benghazi. Petraeus had been scheduled to testify about the Benghazi case on Thursday in a closed session of the committee; Mike Morrell, the acting CIA director, is now expected to do so.

She said the committee may decide to call Petraeus in a future meeting of the intelligence panel on the Benghazi killings. Four U.S. citizens were killed, including Ambassador Christopher Stevens.

"My biggest concern is, there are literally hundreds of threat warnings in the material that has been accumulated," Feinstein said. "There were five attacks during the year, one prior attack on the consulate itself. The question I have is ... why wasn't something done about it?"

U.S. Representative Peter King, the Republican chairman of the House Homeland Security Committee, raised questions about why it took FBI investigators so long to inform President Barack Obama and others in his administration that Petraeus was involved.

FBI TIMELINE QUESTIONED

"The timeline has to be looked at and analyzed," the New York congressman said on CNN's "State of the Union. "Because obviously this was a matter involving a potential compromise of security and the president should have been told about it at the earliest stage."

Republican Senator Lindsey Graham said he was ready to turn the page on the scandal that prompted Petraeus to resign, but said the former general must testify before Congress about what he called a "national security failure" at Benghazi.

Graham, of South Carolina, called for a Watergate-style joint select committee of members of the House and Senate to investigate the matter.

Speaking on "Face the Nation" on CBS, Graham said the Pentagon and the U.S. intelligence community have much to explain in this case, but singled out Susan Rice, the U.S. ambassador to the United Nations, for her role.

"I don't, quite frankly, trust her rendition of Benghazi," Graham said. Rice initially described the attack as a spontaneous outburst rather than a planned attack. Her handling of the matter provided fodder to Republican opponents in the final months of Obama's re-election campaign.

Rice has been mentioned as a possible choice by Obama to succeed Secretary of State Hillary Clinton, but Graham said Rice's nomination to this post "would have incredibly difficult time getting through the Senate."

"I would not vote for her unless there's a tremendous opening up of information explaining herself in a way she has not yet done," Graham said of Rice.
